CLARITY Act fails procedural Senate vote amid Democratic concerns over crypto bill

U.S. Senate blocked the crypto market structure bill, H.R. 3633 or the CLARITY Act, after it failed to clear a critical procedural vote. The cloture motion fell short of the 60 votes required to advance, landing at a 49–50 vote. Because these two monetary forms pose entirely different risks, regulators must govern them through separate frameworks.The Reason for the failure is that lawmakers could not agree on ethics rules or decentralized finance rules.

For years, the crypto industry in the U.S. has operated in a gray area. Two major financial watchdogs—the SEC (Securities and Exchange Commission) and the CFTC (Commodity Futures Trading Commission)—have argued over who is in charge of policing different coins and tokens. This lack of clear boundaries has led to confusion, lawsuits, and uncertainty for businesses.

Regulating Deposit Money

Financial Stability & Fractional Reserves Prudential Oversight: Focuses on capital adequacy ratios (like Basel III) and liquidity stress testing to ensure commercial banks can withstand sudden asset devaluations.

Systemic Risk Mitigation: Mandates participating in lender-of-last-resort frameworks (Central Banks) and public insurance pools to completely eliminate the risk of bank runs.

Credit Controls: Limits how institutions can leverage customer deposits for speculative loans to shield everyday consumer liquidity.

Regulating Bitcoin 

Market Integrity & Consumer Protection Anti-Money Laundering (AML/KYC):
Targets the gateways and on/off ramps (exchanges, brokerages) rather than the base protocol to trace illicit flows.
Custodial Standards: Focuses on ensuring crypto exchanges separate customer funds from corporate assets to prevent structural fraud (e.g., preventing another FTX scenario).
Disclosure & Transparency: Requires clear consumer warnings regarding extreme price volatility and the absolute finality of cryptographic asset transfers.
